Does accusing someone of Racism=disorderly conduct? Re: Gatesgate?

Right on CS. You don't arrest someone for exercising their first amendment rights even if they get a little heated. What do we arrest everyone who raises their voice? Just don't expect the knee-jerk nit wits here to agree with you.
